▬ Declaration of Entrusting Work to a Foreign National ▬
This procedure is available only to citizens of five countries: Ukraine, Armenia, Belarus, Georgia, and Moldova.
▬ Types of Work Permits: A, B, C, D, E, and S ▬
The employer must submit the application for a work permit to the provincial governor (wojewoda). Work permits are issued as administrative decisions by the governor.
A positive decision regarding a work permit of type A, B, C, D, E, or S results in the issuance of an administrative decision by the provincial governor (wojewoda), allowing the foreign national to work in Poland.
In the case of a negative decision, the applicant may appeal to the Minister of Family, Labour, and Social Policy within 14 days of receiving the decision.
A positive decision on registering a declaration of entrusting work to a foreigner in the registry of declarations is made by the District Labour Office (Powiatowy Urząd Pracy) or the County Governor (Starosta).
The formal requirements for each application vary depending on the office where the documents are submitted. Each office may have different regulations, but in every case, the most crucial document is a correctly completed application form.
It is important to note that any foreign national can apply for a temporary residence permit, a permanent residence permit, or an EU long-term resident permit. However, only an employer intending to hire a foreign national can apply for a work permit of type A, B, C, D, E, or S, as well as a declaration of entrusting work to a foreigner.
